Attorney Foreclosure Procedure
Plaintiff/Judgment Creditor
A Judgment Creditor is defined as the creditors (plaintiff or defendants) who are awarded judgment in the foreclosure case. Judgment Creditors are required to register for a Username and Password and fill in all appropriate fields. Per Ohio Revised Code 2329.211, in every action of Judicial Sale or Execution of residential property, if the Judgment Creditor is the purchaser, they shall not be required to make a deposit on the sale. However, Judgment Creditors are required to submit the bidding style choice (pre-sale manage bid or live bid) AND a copy of the court order stating they are the Judgment Creditor on the case they are bidding to Realauction Customer Service (customerservice@realauction.com) at least one (1) business day prior to the sale date. Submission can be done via email or fax. Submission must include the bidder number and user account contact first and last name in the submission. Required Forms
The following forms will be required to be submitted by the plaintiff’s attorney and can be found on: www.medinasheriff.com
1.) Medina County Property Description Approval Form
This form must be submitted for approval to Medina Co. Tax Maps Dept. along with the property legal description. Once approved by Tax Maps, both are submitted with the precipe for order of sale to the Clerk of Courts.
2.) Real Property Conveyance Fee Statement of Value & Receipt
This form must be completed by all purchasers. This form must accompany the Sheriff’s Deed.
3.) Sheriff’s Deed
The deed form is available on the Sheriff’s website for your use. The completed Deed and the Conveyance Fee Form and a prepaid delivery service envelope (as well as any other necessary forms) may be mailed or dropped off at the Sheriff Civil Office 225 East Washington Street, Medina, OH 44256.
4.) Confirmation Order
Within the Confirmation the fees to be paid out should be listed as follows:
First: Payable to the Clerk of Court
Second: Payable to the Medina County Treasurer
Third: Payable to the Medina County Sheriff …$150.00 (flat fee)
Fourth: Payable to the Medina County Auditor for Conveyance Fees … $3.00 per $1000.00 plus .50 cents per parcel number.
Fifth: Payable to the Medina County Recorder for recording Deed … $42.00 and $8.00 for each additional page.
